U.S. Federal Circuit Affirms Invalidation of Bright Data Patents in Ongoing Legal Dispute with Oxylabs

On August 1st, the U.S. Court of Appeals for the Federal Circuit upheld earlier decisions by the U.S. Patent Office (USPTO) that invalidated claims from two patents held by Bright Data. These patents, which Bright Data claims are related to residential proxy technologies, formed a basis of Bright Data’s lawsuit against Oxylabs (Case No. 395), in which Bright Data alleged patent infringement.

Following the jury trial of 2021, the case had been stayed pending the final outcome of related patent invalidation proceedings brought before the USPTO. It is Oxylabs’ position that the Federal Circuit’s decision, upholding USPTO’s invalidation of claims from two of the three patents-in-suit, means that the 2021 jury’s infringement verdict cannot stand. 

Additionally, if all asserted claims from the three patents-in-suit are eventually invalidated, then Oxylabs expects that the case will be dismissed with prejudice. Oxylabs will continue to monitor the developments and consider available options to challenge the previous findings from the jury.

The dispute dates back to 2019, when Bright Data (then operating under the name Luminati) filed its initial suit against Oxylabs, asserting that Oxylabs’ technology infringed its patents purportedly covering residential proxies. Throughout the proceedings, Oxylabs has consistently maintained that it has not infringed any of Bright Data’s intellectual property and that Bright Data’s patents are invalid.

To date, Oxylabs has obtained invalidity findings before the U.S. Patent Office and in court as to claims in twelve Bright Data patents. The latest ruling underscores Oxylabs' ongoing commitment to upholding innovation and integrity in the web scraping industry.
